In dispute resolution, our general approach is to utilise alternative dispute resolution methods and, if that fails to reach a satisfactory resolution, We will prosecute or defend through whichever court is appropriate. That said, we're also well aware that on occasions litigation through the courts at first instance is the most appropriate strategy and on each occasion we will discuss the options with our client.

Our experience includes:
Advising & Negotiation
• Acting in respect of negotiating and drafting, and disputes regarding the delivery of ICT Infrastructure Services and Carriage Services including voice over Internet Protocol (VoIP) services, the integration of third party software with IT infrastructure such as PBXs and soft switches, and licensing arrangements.
• Acting for electrical products manufacturers and suppliers on defective products, including implementing product recalls, notices to the public, liaising with all regulatory authorities as required, and negotiating with distributors.
• Acting for property developers and commercial tenants in relation to the negotiating and drafting of commercial agreements, sale contracts and leases and any disputes arising out of the same. Our experience extends to planning applications at VCAT.
• Acting for executors and plaintiffs in estate litigation, including the estate of the late motor sportsman, Peter Brock.

Defending
• Acting for an ASX listed defendant in the defence of the largest securities class action in Australia commenced by hundreds of unit holders alleging misleading or deceptive conduct and breaches of continuous disclosure obligations following the collapse of the company's share price when lender support was withdrawn.
• Acting for a global energy company on contentious work arising from its downstream activities at the retail, wholesale and distributor level. We also have experience in environmental litigation arising from contamination of service station sites and adjoining lands and defending prosecutions by government authorities.
• Acting for various clients in complying with, or objecting to, subpoenas for production or to give evidence.
• Acting for and advising clients in disputes relating to negligence claims, property and building defects, debt recovery, leases, and product recalls.
